Rising divorce rates in Parramatta is a worrying trend as stated by Parramatta Divorce Lawyers Community. While it may be good news for the divorce lawyers themselves, it is a worrying social trend. A lawyer from the above mentioned community, who did not wish to be named, stated that the numbers had increased in all kinds of age groups. Right from the newly married to the ones who have been married for two-and-a-half decades are falling out. What seems to be driving these figures?
Well, the first reason is the emotional incompatibility in both the spouses. Incongruity in various matters, whether it is on the manner the household is run or on the method of dealing with each other, every emotional issue could trigger a divorce. Lower emotional endurance and intolerance towards others might be some of the reasons for the split. Another marriage breaker could be the inappropriate behaviour or domestic violence. From time immemorial, domestic violence has created an unchangeable rift in marriage. Drug abuse and increased alcohol consumption in the masses are some of the factors that can be attributed to this issue. From a lawyer’s perspective, such cases should be handled delicately, says another anonymous source. A bad settlement could result in further mishandling of the victim spouse.
Other reasons such as the mishandling of monetary assets by one of the spouse, is one of the common causes of the separation. One of the partners could have diverted the marital assets towards an unnecessary expense, or siphoned off the funds to a fictional account. Money-laundering follows next which is a criminal offence. So, to safeguard the interest of the spouse, separation could be the best option. However, the numbers are increasing uninhibitedly. While Parramatta stats are generally lower than the national rate, still a rise is worrying. About 8% of the people were divorced as of 2012.
How do the lawyers infer this situation? What legal measures could serve the client best? According to a unanimous lawyer survey over the issue, a lawyer should first understand the issue as a social responsibility. Assisting a client heading for a divorce in the best possible way is the best solution. A separation lawyer should also assess whether divorce is the best option. If the couple needs to consult a marriage counselor, then one should simply state that. If the matter is still unresolved, or the grievance is authentic, then one should prescribe the necessary measures of a divorce.
Another factor that a divorce lawyer should look out for should be the emergency of the situation. If the necessity of voiding the nuptial agreement is high and the matter involvement of a criminal issue with certainty of a mishap, then a divorce lawyer should not delay and arrange for the necessary safety arrangements for his/her client.
