If an owners corporation obtains an Order for the payment of moneys from NCAT, they can register the debt as a judgment debt with the Local Court (or District Court for amounts over $100,000).
The owners corporation can then apply to the Court for a Garnishee Order on the lot owners’ individual income, or any rent paid by a tenant through a real estate agent. (See Section 122C of the Civil Liability Act 2005).
